(1) The U-NII-1 device is a base station that uses an antenna that reduces energy

radiated toward Globalstar satellites. Specifically, base stations must use an

antenna that limits effective isotropically radiated power (EIRP) to no more

than 125 mW in areas beyond 30 degrees above the horizontal plane. In other

words, this requirement would impose a restriction that is equivalent to -9 dBi

peak gain, and, as a result would further reduce energy received by Globalstar

satellites. Most 5 GHz access point antennas on the market today were not

designed to meet this severe limitation. Accordingly, outdoor Wi-Fi network

operators will need to make a significant new capital investment to deploy 1

Watt U-NII-1 systems, even though their existing antennas would not cause

harmful interference to Globalstar’s operations. Nevertheless, this EIRPbased

framework provides flexibility in compliance with the rule in a manner

that Globalstar’s recommended gain-based proposal does not.4 By limiting

the EIRP directed upward, the existing population of access points could come

into compliance by operating at a lower power level, in contrast to an absolute

gain-based standard that provides no flexibility for the robust Wi-Fi

ecosystem.
