I have two comments:
1) In 11ax, only STA operating in the 6 GHz band has the following requirements:
The following apply to a STA operating in the 6 GHz band:
— The STA shall not use the following pre-RSNA security methods: WEP, Open System authentication
without encryption, Shared Key authentication
So, in 2.4GHz and 5GHz, when the TDLS STA does not have an RSNA with the BSS, you should not disable the TDLS setup between a non-AP MLDs.
2) The AP can control TDLS setup by using the TDLS Prohibited subfield.
TDLS shall not be used when the TDLS Prohibited subfield included in the Extended Capabilities element of
the Association Response frame or Reassociation Response frame that led to the current association is equal
to 1.
The concern that you raised may not have happened on some AP vendor's implementation. At least, I didn't hear any issue.
So, instead of disallowing all TDLS setup within the non-AP MLDs, I prefer to define another the MLD TDLS Prohibit subfield, to indicate whether the TDLS setup between the non-AP MLDs is prohibited or not.
