Thanks for your comment.

I checked with Brian as well as looked at the REVme spec for details on Channel Usage.
Channel Usage element with Usage Mode 3 is used by the client to provide its periodic unavailability to the AP and is not used by the AP.
So, there are no legacy devices that follow Channel Usage from the AP with Usage Mode =3.

More importantly, for the operation of DBE mode we do not need any Channel Usage signaling, which legacy devices won't understand anyway. So it is strongly preferred to keep the feature simple and not add such complexity.

For the DBE, since the legacy device cannot recognize the related DBE signaling, it’s better to use the Channel Usage element to protect the expanded channel (e.g. setting the Usage Mode field to 3 to indicate the corresponding expanded channel is unavaialable). Otherwise, there may exist the coexistence issue. For example. the legacy STAs may use the expanded channel for the off-channel TDLS transmission. The legacy AP may switch to the expanded channel without sufficient channel assessment.
