France ARCEP recently began a consultation that asks for public opinions on its draft Draft decision on the use of radio spectrum in the frequency bands 5150-5250 MHz, 5250-5350 MHz and 5470-5725 MHz for the implementation of wireless access systems, including radio local area networks.
In particular, following the European Commission's Implementing Decision (EU) 2022/179 dated 8 February 2022, ARCEP asks for public opinions on the following revision:
a) allow the use of the 5150-5250 MHz band for indoors, including installations inside road vehicles, trains, and aircraft with power limited to 200 mW (eirp), except for installations inside train carriages and for installations inside road vehicles for which the power is limited to 40mW;
b) allow limited outdoor use of the 5150-5250 MHz band including use of the 5170-5250 MHz band by unmanned aircraft systems (max 200 mW);
c) allow the use of the 5250-5350 MHz band only indoors with power limited to 200 mW (eirp). Outdoor or indoor use of vehicles, trains, and aircraft is not permitted;
d) allow the use of the 5470-5725 MHz band for indoors and outdoors with power limited to 1 W (eirp). Use inside train carriages or road vehicles as well as for drones is not permitted.
e) A transitional regime is provided for the operation of WiFi installations using the 5250-5350 MHz and 5470-5725 MHz on board airliners, which began to be deployed based on the previous regulatory framework. Thus, these specific uses remain authorized until 31 December 2028 with an emission limit of 100 mW EIRP max.
