On 14 August 2023, Philippines NTC published a notice of hearing for its draft memorandum circular (MC) entitled "Spectrum users fees for radio frequency bands: 2400MHz to 2483.5MHz, 5150MHz to 5350MHz, and 5470MHz to 5850MHz".

Under the proposed MC, entities need to pay spectrum user fee for base stations not covered under Section 2 of this Circular (copied below), and fixed radio stations as defined under Section 1.2 of NTC Memorandum Circular No. 002-09-2021 to operate in the above-mentioned frequency bands:

2.1. PTEs offering free internet access service in public places within the 4th, 5 th, and 6th class municipalities as published by the Philippine Statistics Authority. Public places under this circular shall include the following: 
i. National and local government offices; 
ii. Public basic education institutions; 
iii. State Universities and Colleges and Technical Education and Skills Development Authority (TESDA) technology institutions; 
iv. Public hospitals health centers, and rural health centers; 
v. Public parks, plaza, libraries and barangay reading centers; 
vi. Public airports and seaports; 
vii. Public transport terminals; and 
viii. Other public places determined by the Department of Information and Communications Technology (DICT) under Sec. 7 of the Rules and Regulations Implementing Republic Act No. 10929, known as the Free Internet Access in Public Places Act. 

2.2. PTEs, granted authority by NTC through their certificate of public convenience and necessity or provisional authority to offer internet/data services, that are under contract with the Department of Information and Communications Technology (DICT) pursuant to Sec. 6 of Republic Act No. 10929, The Free Internet Access in Public Places Act. 

2.3. Value-Added Service (VAS) Providers under Sec. 1.2 above. 

2.4. Local Government Units (LGUs) intending to set up outdoor radio base station within their respective areas of jurisdiction in order to provide free public internet access service. 

2.5. Persons and entities intending to set up outdoor radio base station for private use within 4th, 5th, and 6th class municipalities as published by the Philippine Statistics Authority. Such networks shall not be used for commercial purpose
