Over three years passed since my inquiry regarding the US patent
6,185,258, "Transmitter diversity technique for wireless communications" by
Alamouti and Tarokh, assigned to AT&T Wireless Services Inc. At a time, you
made an attempt to receive an assurance letter from AT&T Wireless, but to no
avail. In spite of lack of such assurance letter, the committee voted (during
Sponsor Ballot comment resolution) that the Alamouti Space Time Coding scheme
remain in the standard.
I am not sure about the procedural coherence of the
decision made in January 2003 (during the approval of 802.16a), but now we have
a chance to set the record straight. With the advent of the 802.16 maintenance
standard, and the 802.16e standard which both incorporate Alamouti's
technique, I am asking you to approach AT&T Wireless again and ask them to
provide the appropriate assurance letter. I am sure that over the years passed AT&T have
become aware of this patent, and you will not have same trouble as before to
establish contact with them.
In the
case that such assurance letter is not provided in a time reasonable from
project's timeline perspective, I ask that all the STC content shall
be extracted from the 802.16-2004 standard as part of its maintenance, and
corresponding changes be made also to successor projects.
To
comment on the procedural side, I'm sure that given the clear IEEE policy on
this issue, this is not in the hands of the voters - either there is a letter of
assurance or there isn't one.
Given
the immense technical merit of Alamouti's STC scheme, I hope that this issue
will be resolved and that the STC scheme will remain part of 802.16
standard.

My attention was drawn recently to US

communications" by Alamouti and Tarokh, assigned to AT&T Wireless Services
Inc. The "Alamouti transmit diversity technique" is part of 802.16ab draft and
was believed at a time to be patent-free. In view of the publication of the
aforementioned patent and its probable relevance to our standard, I'm asking
you to apply the patent procedure and write to AT&T Wireless regarding
their patents applicable to 802.16ab in general or at least to the US
6,185,258 patent in particular.
