Re: [802-LMSC] Updates slides from appeal meeting today.

James,

I’ve accepted your invitation to read the P&P. This is interesting.

I see that there was a message from ten individuals around Sept 1 that said "This appeal to the LMSC is submitted…” But I also understand that you did not take it as an appeal but as a complaint for resolution, per:
If the procedural concern is not resolved after presentation to the subgroup for resolution, the complaint regarding any procedural action or inaction on the part of the Standards Committee, or a Standards Committee’s subgroup, shall be presented to the Standards Committee for resolution. If the party bringing the complaint determines that the Standards Committee’s proposed resolution is unacceptable, such party can file a procedural appeal with the Standards Committee.

I wonder why I didn’t pick up on this point earlier. Perhaps I was confused because the meeting title, the agenda item, and the slides used the word “Appeal.” Also, the participants were strictly referred to as "appellants" and "appellees.” I think that could have given me that impression an appeal was underway. Reviewing the P&P, I see that the "complaint for resolution" is not an appeal, so I feel like alternative terms would have been more accurate.

So I wonder if there is even a slight possibility that the individuals who submitted the complaint identified as an appeal believed that it was an appeal. I think it’s possible, and I see indications in the documentation that they thought this way.

With that in mind, I think it would be best if you were to inform the complainants that their complaint was treated as a complaint for resolution.

Cheers,

Roger

I did not author 15-26-0446-03.   You would need to ask the author what they meant by that statement.

My slide is correct, we were at the step of the LMSC rendering a decision.

That decision may be formally appealed, which requires that I form an appeals committee who then selects an appeal panel.  If you are curious, that step is described in detail in the IEEE 802 LMSC Policies and Procedures.

James,

Can you clarify Slide 7? I understand that it’s saying that the current status is:
Ask the LMSC for a suggested resolution ← We are here
and a future alternative may be:
File a formal LMSC appeal

But IEEE 15-26-0443-01-0000 says:
The rejection was subsequently appealed with the LMSC to reverse the ruling

So my understanding is that today’s meetings took place after the formal LMSC appeal.

Cheers,

Roger

All

I have updated my slides with corrections.

I have also added the three LMSC members who recused themselves.

The report out of the Executive Session is on the last slide and contains the IEEE 802 LMSC decision regarding the appeal.
